ARTICLE 1 : Subject
The purpose of these General Terms and Conditions of Sale (GTC) is to define the terms and conditions governing the rental of virtual exhibition spaces on the Cyberexpo3D platform, offered by Digital Soft, a company registered with the Paris Trade and Companies Register under number 510 241 375, hereinafter referred to as "the Seller." Any user wishing to rent a virtual exhibition space is invited to review these GTC before subscribing. Subscribing to a virtual exhibition space implies unreserved acceptance of all the provisions of these GTC.
ARTICLE 2 : Définitions
Platform: refers to the online platform Cyberexpo3D.
Exhibitor: refers to any individual or entity that has entered into a contract for the rental of an exhibition space on the Platform.
Exhibition Space or Booth: refers to the virtual space allocated to the Exhibitor to showcase their products or services.
Visitor : refers to any person connecting to the Platform to visit an exhibition.
User: refers to any person using the Platform, whether an Exhibitor or a Visitor.
ARTICLE 3 : Account Creation
To access the services of the Platform, the User must create a visitor or exhibitor account by providing the requested information. This information must be accurate and complete.
ARTICLE 4 : Exhibitions
Exhibitions are virtual events organized on the Platform, allowing Visitors to explore the Exhibitors' stands in an immersive environment. The content of the Exhibitions may be modified at any time by the Seller.
ARTICLE 5 : Exhibition Spaces
Subscription : The subscription to an exhibition space is made online, by following the instructions provided on the Platform.
Customization: The Exhibitor has customization tools to arrange their stand according to their needs. The Seller provides documentation and technical support to assist the Exhibitor in this process.
Content : The Exhibitor is solely responsible for the content of their stand and agrees to comply with applicable laws and regulations, as well as these General Terms and Conditions of Sale.
ARTICLE 6 : Prices and Payment
Pricing: The rates for exhibition spaces are displayed in euros, including all taxes (TTC), on the Platform. They may be changed at any time.
Payment : Payment is made online via [list of accepted payment methods]. The contract is considered valid upon payment confirmation.
ARTICLE 7 : Order and Delivery
The order is considered effective upon payment confirmation. A confirmation email is sent to the Exhibitor. Access to the exhibition space is typically immediate after payment validation.
ARTICLE 8 : Obligations of the Parties
Seller : Provide the Exhibitor with access to the Platform and the necessary tools for customizing their stand. Ensure the proper functioning of the Platform to the extent possible.
Exhibitor : Use the Platform in accordance with these General Terms and Conditions of Sale. Not infringe upon the rights of third parties (intellectual property, etc.). Comply with rules of good conduct and not distribute illicit, defamatory, or immoral content. Provide accurate and complete information when creating their account and subscribing to an exhibition space.
ARTICLE 9 : Intellectual Property
All intellectual property rights related to the Platform, its content, and customization tools are exclusively owned by the Seller. The Exhibitor only acquires a non-exclusive license to use their exhibition space.
ARTICLE 10 : Personal Data
The processing of personal data is governed by our privacy policy.
ARTICLE 11 : Liability
The Seller shall not be held liable for direct or indirect damages resulting from the use of the Platform by the Exhibitor, except in cases of gross negligence or fraud on its part.
ARTICLE 12 : Force majeure
The parties shall not be held liable for the non-performance of their obligations if it results from a force majeure event.
ARTICLE 13 : Duration and Termination
The duration of the exhibition space rental is defined at the time of subscription. The contract may be terminated by either party under the conditions set forth in these General Terms and Conditions of Sale.
ARTICLE 14 : Right of Withdrawal
Since the exhibition space rental service is customized, the legal right of withdrawal does not apply.
ARTICLE 15 : Governing Law and Jurisdiction
These General Terms and Conditions are governed by French law. Any dispute regarding the interpretation or execution of these CGV will be subject to the exclusive jurisdiction of the courts in Paris.
ARTICLE 16 : Amendments to the GTC
The Seller reserves the right to modify these General Terms and Conditions at any time. The new CGV will apply from the moment they are published online on the Platform.
